The My Safe Florida Home (MSFH) Program ceases operations June 20, 2009

URGENT!  If you have been approved for a MSFH Grant, take action immediately. 

There are approximately 9,000 homeowners who have had their grants approved, but have not yet strengthened their homes and have not submitted paperwork to receive a reimbursement.  The work must be done and completed paperwork must be sent to the MSFH program postmarked no later than June 30, 2009.  The program will reimburse homeowners with grants already approved through June 30, 2009.

I received notification on 6/18/09, that the MSFH Program will cease operations on June 30, 2009.  Effective immediately, the Program is no longer taking applications for home inspections or grants.  When the economy recovers, Florida’s Chief Financial Officer, Alex Sink, hopes to seek funding and restart the program sometime in the future.

Murzin’s HB7123 is signed into law – Protection of Florida’s Military Bases and Missions
On 6/18/09, Governor Crist signed into law HB7123, a bill I sponsored in April to enhance the state’s efforts in maintaining defense installations in our great state. The military presence in our state is a powerful and constant economic driver with an estimated $52 billion impact statewide.  It is our third largest industry and creates thousands of direct and indirect jobs.

The bill creates a Florida Council on Military Base Mission Support.  The Council will be responsible for providing community and state support to the 20 installations and three unified commands in Florida that would not only keep current infrastructure intact, but also promote the transfer of more military assets to Florida.   As the new administration in Washington is reviewing military missions across the board, it is good to have this law in place.  I commend Senator Gaetz for ensuring the bill’s passage in the Senate and Governor Crist for his signature.

Governor Crist signed the bill into law on 6/18/09 at Eglin Air Force Base which is the largest Air Force installation in the world.  Northwest Florida houses five of the 21 military bases in Florida.

The Council will be made up of gubernatorial appointees and House and Senate members.  The Council will work to strengthen Florida’s relationships with the military and help prevent any future base realignment rounds from negatively impact our state.

Florida Chamber Commends “Distinguished Advocate” Rep. Dave Murzin (6/19/09)

Today, I was honored to have the Florida Chamber of Commerce recognize me as a “Distinguished Advocate.”  A Distinguished Advocate is one who fights for Florida’s employers by standing for fairness in Florida’s judicial system to protect Florida’s employers from abusive and costly lawsuits.  An Advocate fights on behalf of Florida’s taxpayers and job creators to reduce costs and invest in Florida’s future innovative economy.

Additionally, the Florida Chamber recognized me for receiving a perfect 100 percent on the Chamber’s 2009 Legislative Report Card, as well as a 97-percent in 2008.  The Florida Chamber’s membership represents employers, small and large, from all industries and regions across the state. Military Base Closure HB 7123 Signed by Governor Crist 6/10/09
HB7123 is one of my favorite bills that I sponsored this past session.  The bill establishes the Florida Council on Military Base and Mission Support. This important legislation will allow the Florida Legislature to show its support and work to ensure that our military installations are protected when the federal government next decides which bases are to be closed. 

Being pro-active and engaged with our military partners will go a long way to keeping this important economic driver in our community. I look forward to working closely with this new Council in the coming year.

Hurricane expo is June 20 at Pensacola Civic Center
On Saturday, June 20, the Be Ready Alliance Coordinating for Emergencies Hurricane Expo will be held at the Pensacola Civic Center from 10 a.m. to 4 p.m. According to the Pensacola News-Journal, exhibitors will provide information on services and products that help in the preparation for and mitigation against disasters. Expo visitors will benefit from special discounts of up to 50 percent off home inspections, which can help save money on homeowner’s insurance premiums.

Dori Slosberg and Katie Marchetti Safety Belt Law -- CS/SB 344 Signed by Gov 5/6/09; Effective 6/30/09
A new seat belt law goes into effect in Florida on June 30, 2009.  SB 344 amends the “Florida Safety Belt Law” to provide for primary enforcement of the safety belt law for operators and front seat passengers.  The bill amends Florida Statutes 316.614 and allows law enforcement officers to stop motorists solely for not using their safety belts.  A person violating this section would be cited for a nonmoving violation, punishable by a $30.00 fine.

The bill also removes from the list of exemptions to the safety belt law front seat passengers of a pickup truck in excess of the number of safety belts installed.  The operator and any front seat passengers of a pickup truck will be subject to primary enforcement of the safety belt law.

The amendment to the Safety Belt Law may qualify Florida to take advantage of a federal grant offered to states passing primary enforcement safety belt laws.  The potential grant could be as high as $35 million.  The federal money a state receives can only be spent on highway-related projects.

Last week, the Florida House began the final sprint toward approving a responsible, balanced budget by meeting with the Senate to iron out differences in each chamber’s budget proposals.  Due to extensive negotiations, both chambers decided to extend the regular Session through this Friday to address the budget.  The extended Session is not without precedent, and House Republicans believe that it is more important to get the budget done right than to do it quickly.  Although the budget process took a little longer than anticipated, it is important that the priorities of both the House and the Senate are fairly represented in the final budget. .

LONG-TERM VIEW ON BUDGET
The House’s priority has been to identify responsible spending reductions to help us balance the budget long-term. I believe it is important to have a fiscally responsible long-term view that puts Florida in the best shape possible to rebound when the economy picks up.  This means House Republicans have to make some tough choices.  The responsible thing to do is stop spending more than Florida can afford so that we can create a stable financial environment for Florida's economy to rebound.

A HELPING HAND FOR FLORIDA’S UNEMPLOYED
I know that times are tough and that Floridians are hurting.  The Florida House is committed to lending a helping hand to those Floridians who have lost their jobs due to the economic downturn.  That is why I voted to accept nearly $2 billion in federal stimulus money to extend the length of time that unemployed workers receive assistance.  Part of the $2 billion will also be used to increase the weekly unemployment benefit by $25, to help Floridians until they can find another job.  I realize that federal stimulus dollars are not a silver bullet for the problems facing Florida, but these funds can help us bridge the gap for unemployed Floridians until they can find another job.

PRESERVING WOKERS’ RIGHT TO A SECRET BALLOT
It is no secret that our state and our nation face unprecedented economic challenges. And my focus is to help put Florida’s economy back on track and generate jobs for Floridians. Included in that focus is the protection of workers’ rights. To that end, the Florida House took a significant step toward helping our economy by voting to provide Floridians with the opportunity to enshrine their right to vote by a secret ballot in the Florida Constitution. I supported passage of House Joint Resolution 1013 because it is a pro-worker protection proposal.  Workers should never fear retaliation from their unions, their employers or their fellow employees.

PROVIDING CHOICE FOR FAMILIES PREPARING FOR COLLEGE
Paying for college is a difficult challenge for parents, especially during these difficult economic times. Many families have planned ahead for college expenses by purchasing the Florida Prepaid College Plan, and I supported House Bill 315 to maximize their choice for the use of their Prepaid College Plan dollars.  House Bill 315 permits the use of a Prepaid College Plan at any learning center recognized by the U.S. Department of Education.

The Florida House met this week to discuss and debate bills that go to the heart of our focus this Session - recharging Florida’s economy and helping create jobs for Floridians. Included among the week’s highlights are bills that streamline the growth management process, prevent drastic rate increases for Citizen’s Insurance customers, allow for consumer choice in the residential property insurance market, protect Floridians’ freedom of speech and a measure to eliminate a state-pay practice known as “double-dipping.”  All of these measures serve as a backdrop to our main goal – passing a balanced and responsible budget that meets Florida’s future needs without penalizing Florida’s families and businesses. 

Ending “Double Dipping”
I have always valued the hard work and dedication of our state employees.  All too often, their dedicated service to the state goes unrecognized and like all Floridians, they are also feeling the effects of the economic downturn. Unfortunately, the current retirement system includes a loophole which not only increases costs for the government (and Florida taxpayers) but also creates a situation which is not fair to either the taxpayer or the rank-and-file state employee.  Under the current system, a state employee can retire and return to work in 30 days while collecting retirement benefits and a state salary at the same time. This unfair, costly loophole needed to be closed. To that end, the House took a significant step toward increasing government accountability by passing House Bill 479, which extends the period of time state employees must stay in retirement to six months or they will be required to forfeit their pension. It also prohibits renewed enrollment, meaning state employees cannot accrue a new pension in addition to the original pension they already earned.

Streamlining the “Growth Management” Process
Intelligent, common-sense growth will play an important role in recharging Florida’s economy.  To create incentives that will promote responsible development in urban areas and reduce sprawl, the House passed House Bill 7127 this week. House Bill 7127 strikes a balance between state and local control of growth management by retaining state regulatory oversight of planning and development processes, while recognizing the role and responsibility of local elected officials to make land use decisions in the best interests of their local community.  Additionally, local oversight leads to more responsible environmental controls over growth.

Freedom of Speech
Freedom of speech is a right we, as Americans and Floridians, hold very dear. To underscore my belief in the fundamental right to freedom of speech, I supported House Bill 949 that protects Floridians from libel lawsuits filed in foreign courts, often by individuals with ties to organizations like al Qaeda and Hamas. The measure will help in the fight against a tactic known as “Libel Tourism.”  I am pleased that the measure supports both freedom of speech and freedom of the press while helping to fight terrorism by closing a loophole in the law which gave shadow groups a cash cow to fund their activities.

Florida’s March Existing Home Sales
I was pleased to see Florida’s existing home sales numbers this week from The Florida Association of Realtors® (FAR.). Overall, the home sales increased in March, making it the seventh month in a row that sales activity demonstrated gains in the year-to-year comparison.  Existing home sales rose 30 percent in March with a total of 13,085 homes sold statewide compared to 10,080 homes sold in March 2008. Statewide existing home sales in March were 32.7 percent higher than February’s statewide sales.  Stunningly, Florida’s median sales price for existing homes last month was $141,300; a year ago, it was $201,700 for a 30 percent decrease.

Budget Update
The Florida House on Friday passed a $65.1 billion budget which increases per-student funding, protects per-student classroom dollars, continues to fund health care services to those in need, and makes sure that public safety is maintained.

Some highlights from the House version include:

  • Raises per-student funding by over $30 per student to a statewide average of $6891.
  • Increases funding to the Department of Veterans Affairs, Department of Children and Families and Agency for Persons with Disabilities among others.
  • No reductions that will hinder constitutional due process.
  • No reductions in vital probation or security officers who work with offenders and protect the public.

The Senate budget proposal has several differences that we will work out in conference. However, the House bill, by increasing education funding and forgoing the tobacco tax, is a well-balanced budget that would stimulate growth and protect the state’s priorities.

Class Size Amendment Revisions
Also on Friday, the Florida House approved Legislation giving Florida voters the opportunity to support a common-sense revision to the Class Size Amendment that will keep class sizes small in Florida and give principals and teachers needed flexibility.  House Joint Resolution (HJR) 919, sponsored by Representative Will Weatherford (R-Wesley Chapel), preserves the constitutional integrity of the Class Size Amendment approved by Florida voters in 2002 by holding class size measurement at the school average level with limits on individual classroom sizes.

HOLIDAY GREETINGS
To all the Jewish families celebrating Passover, I wish you a happy and healthy holiday. It is important to remember the strength our ancestors possessed as they overcame their mighty struggles. While uncertain times are upon us, the victory in battles of yesteryear show we can make it through these perilous challenges and remain free.

I also wish warm greetings to those celebrating Easter. The resurrection of Jesus Christ and the remembrance of his life and teachings continue to resonate today. As families and friends gather to enjoy the holiday, I hope reflection and thanks for our great blessings fill all hearts.

NORTH FLORIDA FLOODING
Over the past week, I have been paying close attention to the severe weather throughout North Florida. I have been pleased with the Department of Emergency Management’s efforts in protecting citizens and keeping us informed.

As you might know, there have been two fatalities in Okaloosa County. Please be careful out there and pay attention to any emergency messages as flood conditions can quickly change. For up to the minute information, please visit: http://www.floridadisaster.org/index.asp

PROTECTING FLORIDA’S HOMEOWNERS
It has become evident that neither Citizens Insurance nor the Florida Hurricane Catastrophe Fund (CAT Fund) would be sufficient to pay for costs incurred by Florida homeowners should a major storm hit the state’s shores.  Additionally, homeowners need assistance in hardening their homes against wind damage to help lower everyone’s insurance rates. To address these issues, last week saw the passage of House Bill 1495 in the House Insurance, Business & Financial Affairs Policy Committee.

This legislation will responsibly diminish Florida taxpayers’ liability associated with catastrophic costs resulting from a major storm event hitting Florida’s shores.  The bill also provides incentives for hardening homes against wind damage.  The legislation was passed by the House Insurance, Business & Financial Affairs Policy Committee last Friday morning.  If passed by the full House, the bi-partisan measure would reduce Florida’s exposure in the CAT Fund by $12 billion over six years and increases dollars available for the My Safe Florida Home Project, which helps homeowners finance new storm windows and fortify their roofs against wind damage.  Floridians want to purchase insurance from people they know will pay their claims and this legislation underscores our commitment to protecting Florida homeowners by reducing Florida’s liability while incentivizing homeowners to protect their investment and providing funds for paying property damage claims.

PROVIDING ACADEMIC EXCELLENCE FOR FLORIDA’S CHILDREN
Even in tight budget times, per-student classroom spending and making sure our children receive a world-class education remain a top House priority.  Underscoring the House’s commitment to prepare our children to compete in the global economy, the House PreK-12 Appropriations Committee released its proposed spending plan on Tuesday.  The plan includes more than $800 million added to the House schools budget for an increase of about $30 in per-student spending for the coming year. To provide additional funds for education during these challenging economic  times, we are transferring funding that had been previously designated for capital costs to be used for operating costs and giving school districts flexibility to move those funds back to capital expenditures if needed for debt service payment or urgent construction needs. That puts potentially $380 million more into basic school operating budgets and provides funding at a critical time for Florida schools.

LOCAL SALVATION ARMY IN NEED OF ITEMS FOR RESALE
The Salvation Army’s programs in Escambia and Santa Rosa Counties are funded through the selling of gently used donations. Unfortunately, due to local economic issues and a dramatic 45% drop in the level of donations in the last 4 months, The Salvation Army Family Thrift Store is hard pressed to be able to make much needed appropriations.

All gently used items are accepted for donation from 9:00 a.m. to 5:00 p.m. any day of the week at 8187 West Fairfield Drive, Pensacola, Florida.  If pick up and transportation of donated items is required, The Salvation Army can be contacted locally by calling (850) 432-1943.

This week marked the end of committee meetings in the Florida House.  Committee weeks are always fast-moving as each member works to have their bills heard favorably.  I was pleased to have four of my bills heard this week and look forward to presenting them on the House floor.

BROADBAND ACCESS
Legislation to achieve universal broadband access in Florida passed the Economic Development & Community Affairs Policy Council on Wednesday.  PCB EDCA 09-03, introduced by Representative Dave Murzin will allow the Department of Management Services (DMS) to draw down federal funds available for broadband mapping and deployment. 

I believe this PCB, now HB 7091, will powerfully impact economic development in Florida. With a state as large and diverse as ours, this effort will even the playing field here in Northwest Florida all the way to Keys. 

CHAMBERS DIFFER ON GAMBLING
As both the House and Senate begin to look towards legislation dealing with the impact of Governor Crist’s decision to sign a gaming compact with the Seminole Indian Tribe, it is apparent that the two Chambers differ in their approach.  The House’s proposal grants the Seminoles a slot-only agreement and the offer of geographic exclusivity in certain areas of Florida.  This is less than the offer that Governor Crist offered them with blackjack and slots.   The Senate has taken a different approach by looking to offer the Seminoles full Atlantic City-style casinos- not just slots and blackjack, but also other table games like craps and roulette- and lower the legal age limit to gamble from 21 to 18 years old.  The Senate has also indicated they are prepared to place video lottery terminals at other locations throughout the state in an effort to bring in more revenue for the state.  Both Chambers will continue their work on this matter throughout the rest of the Legislative session.

BUDGET PROCESS TO BEGIN MOVING NEXT WEEK
Next week we will see the budget process begin as budget committees meet to make their first budget proposals.  Throughout the session House members have been reviewing the budget line-by-line to find ways the state can spend more efficiently and effectively.  We have also examined the budget to make sure that state agencies are focused on the core missions of government.  Facing a multi-billion dollar shortfall, I believe these reviews will serve House members well as we look for ways to meet our constitutional mandate to balance Florida’s budget.

FLORIDA BACKYARD CARD
This week, Governor Crist announced the “Florida Backyard Card,” a grassroots effort to help Floridians save money. The following are some key points from his press release:

The State of Florida is pleased to join the coalition of businesses rewarding customers through the Florida Backyard Card. With support from the Florida Lottery, the Backyard Card will be available at lottery retailers across the state. In addition, VISIT FLORIDA is managing www.FloridaBackyardCard.com, where consumers can download a card and search for the best deals in their backyard.

When Floridians spend with local businesses, their dollars go to employee wages, building rent, utilities and state and local taxes which support schools and emergency services. Every purchase impacts our economy. In fact, 75 percent of Florida’s gross domestic product comes from consumer spending.

State Budget Update
The Revenue Estimating Conference is meeting today to release their revenue projection for the current and coming fiscal years.  It comes as no surprise to Floridians that state economists have determined that the state’s fiscal situation has slipped.  The Governor’s original budget proposal is no longer a viable option for the Legislature to consider because his budget was based on previous revenue estimates that are now out-of-date.  Florida revenues have continued to decline and the state is now facing a shortfall of over $6 billion

As you know, the best way to improve the state’s budget outlook is to help improve the budgets of Florida’s families. I and my colleagues are working hard to get the budget balanced and the state’s economy back on track.

Class Size Amendment
While the Class Size Amendment has had some success in improving test scores, its impending requirements will likely have an adverse effect on our students. Some school districts from around the state are exploring whether it is worth transferring entire classes from one school to another to avoid penalties. This isn’t what Florida voters anticipated when they passed the amendment.

To address this issue, Rep. Will Weatherford (R- Wesley Chapel) is sponsoring House Joint Resolution 919 to give voters the opportunity to support a common-sense revision. By giving some flexibility to our principals and teachers, Florida’s education focus can stay where it belongs: classroom learning. School board and school superintendent associations are supportive of this measure, and I look forward to helping with its passage.

Transportation Project Opportunities
In anticipation of receiving federal funds from the American Recovery and Reinvestments Act of 2009 (ARRA) for transportation projects in Northwest Florida, the Florida Department of Transportation (FDOT) has scheduled information meetings throughout the state to ensure that interested parties, including minority and small businesses, are informed of projects that will receive stimulus funds.  The purpose of the meeting is to match potential prime contractors with the available firms, or subcontractors, that can provide services and are certified as a disadvantage business enterprise (DBE), minority business enterprise (MBE) or small business enterprise. FDOT will provide an overview of the state highway system projects being considered for possible funding from the ARRA as well as projects that have been requested by counties in the district.

In reading the March 6 attack on my bill history related to Florida nursing homes, one point that Ms. Atteberry omits is any mention of how rampant lawsuits in the 1990's nearly ended this much-needed service for our state's elderly, as well as her role in promoting these lawsuits.

In the 1990s, Florida nursing homes were deluged with lawsuits that enriched trial lawyers and put about a fourth of the state's facilities in Chapter 11. Trial lawyers publicly demonized long-term caregivers as uncaring and greedy. In 2001, the Florida Legislature found the rise in lawsuits had become a serious problem, and that suing nursing homes into bankruptcy did nothing to improve care for residents.

When targeted nursing home companies fled the state, a number of facilities closed their doors for good, sending their frail elderly residents elsewhere. Pensacola's Magnolia Manor was one of them, and its closure forced our hometown residents to find new nursing homes as far away as Gainesville. Florida's Legislature took action and passed landmark elder care legislation that was overwhelmingly approved, wisely requiring increased direct-care staffing (now among the highest in the nation) and quality improvement programs that have since dramatically improved care.

Your readers would be better served by understanding this history of nursing homes in our state, including how these facilities rely heavily on state and federal funding to operate as a business (almost two-thirds of their financing comes from Medicaid).  Evident is Ms. Atteberry's fundamental misunderstanding of the bills I have historically sponsored, which allow facilities to focus their resources on improving care and giving staff more time to spend at the resident's bedside. I have always been a supporter of our state's inspection process and the staffing requirement for caregivers in nursing homes. I do believe; however, that nursing homes must be adequately reimbursed by Medicare and Medicaid for the care they provide and in doing so, it will allow them to go well beyond the minimum staffing levels, as most do, and to deliver a quality of care the elderly residents expect and deserve.

I would expect this misrepresentation on my efforts to seek a fair legal system for providers and residents in nursing homes.  What Ms Atteberry fails to mention in her byline is that she financially gains through employment from plaintiff attorneys pursuing nursing home claims.  She fails to mention that it is in her financial interest to keep the nursing home lawsuit mill humming along.  Balance is clearly not in her interest.

HB 493 is another attempt to ensure state and federal funding is used on resident quality care and not as a means to fund lawsuits brought on by trial attorneys. It does not, as Ms. Atteberry suggests, make it easier for nursing homes to get away with poor care. Instead it ensures that punitive conduct is weighed out by a judge when allegations are brought forth, giving both parties a level playing field. It does not keep secret those state inspection reports; those can be viewed by the public at any time on the Agency for Health Care Administration's Web site. When nursing homes make a mistake, they should be held accountable, and HB 493 does nothing to change that. It simply ensures fairness in the legal process.

Nursing homes are a necessity for a number of very frail and elderly Floridians, and if we continue to demonize them in the public view, as well as in our court system, we are not only harming their ability to secure support for their necessary functions, but are also making it harder for families when they must make the painful decision that their relative requires this level of care.

1. Session Begins
The 2009 legislative session began Tuesday here in the Capitol. While the first day is always exciting, we did not and will not lose sight of our goal to balance the budget and get the economy back on track.

The House convened a ceremonial session in the morning, and in the evening, the Governor gave his State of the State address and outlined his legislative priorities. I thank the Governor for his optimism, and am eager to work with him as the Legislature works through budget cuts due to this year’s anticipated revenue shortfalls.
 
2. Border County Legislation
On Wednesday, the Economic Development Policy Committee reported favorably on a proposed committee bill that would directly impact our region. PCB EDP 09-01 would expand the definition of rural in several sections of the Florida Statutes to include counties that exhibit rural characteristics but exceed population thresholds. With this change in the definition, some Northwest Florida counties will be able to access REDI resources and state infrastructure grants, if available, as well as technical assistance

These changes will help Florida’s border counties be more competitive with neighboring states. Especially in Escambia County, where we are adjacent to Alabama on two sides, we have a real need to level the playing field and ensure our business community can compete strongly in a multistate region.

3. County Road 399 Reopening
 J. Earle Bowden Way, County Road 399, was reopened on Friday with a ribbon cutting ceremony. As you may recall, Hurricanes Dennis and Ivan washed out this important connection between Navarre and Pensacola Beach.  I regret that my work in Tallahassee did not permit me to attend the ceremony, but I look forward to driving on CR 399 soon.

4. Auto-Repair Tips
With the economy down, many of us are choosing to repair older vehicles instead of purchasing new ones.  In doing so, we all should take appropriate measures in choosing a repair mechanic. Appropriate measures include asking for references and checking with the Better Business Bureau to see if any complaints have been filed. During these tough times, we all have to be diligent in protecting our property and assets.
